為深(shen)入(ru)學(xue)習貫徹習近平新時代中(zhong)(zhong)國特色社會(hui)主(zhu)義思想和黨的十九(jiu)大精神(shen),認真落實中(zhong)(zhong)央經濟工作(zuo)會(hui)議和政(zheng)府(fu)工作(zuo)報告(gao)部署要求,進一步全面放開經營性電(dian)力(li)用(yong)戶發用(yong)電(dian)計劃,提高(gao)電(dian)力(li)交易市(shi)場化程度,深(shen)化電(dian)力(li)體制改革(ge),現就全面放開經營性電(dian)力(li)用(yong)戶發用(yong)電(dian)計劃有(you)關要求通知如下。


一(yi)、全面放開(kai)經營性電力(li)用(yong)戶發用(yong)電計劃


(一)各地(di)要統籌推(tui)進全面放開經營性電(dian)力用(yong)戶(hu)發用(yong)電(dian)計劃工作,堅(jian)持規范有序(xu)穩(wen)妥的原則,堅(jian)持市場(chang)(chang)化(hua)方向(xiang)完善價(jia)(jia)格(ge)(ge)形成機制,落實(shi)清潔能源消(xiao)納要求,確保電(dian)網安全穩(wen)定運(yun)行和(he)電(dian)力用(yong)戶(hu)的穩(wen)定供應,加強市場(chang)(chang)主體準入、交易合同、交易價(jia)(jia)格(ge)(ge)的事(shi)中事(shi)后監管。


(二)經(jing)營(ying)性(xing)電力(li)用(yong)戶(hu)的發用(yong)電計劃原則上全部放開(kai)。除(chu)居民(min)、農業(ye)、重要公用(yong)事業(ye)和公益性(xing)服(fu)務(wu)等行業(ye)電力(li)用(yong)戶(hu)以及電力(li)生產供應所(suo)必需的廠用(yong)電和線損(sun)之外,其(qi)他電力(li)用(yong)戶(hu)均屬于(yu)經(jing)營(ying)性(xing)電力(li)用(yong)戶(hu)。


(三)經(jing)營性電(dian)(dian)力(li)用(yong)(yong)(yong)戶中,不(bu)符合(he)國家產(chan)(chan)業政策(ce)的(de)電(dian)(dian)力(li)用(yong)(yong)(yong)戶暫不(bu)參與市場化(hua)(hua)交易,產(chan)(chan)品(pin)和工藝屬于(yu)《產(chan)(chan)業結構調(diao)整指導目(mu)錄》中淘(tao)汰類(lei)和限(xian)制類(lei)的(de)電(dian)(dian)力(li)用(yong)(yong)(yong)戶嚴格(ge)執行現有差別電(dian)(dian)價政策(ce)。符合(he)階梯(ti)電(dian)(dian)價政策(ce)的(de)企(qi)業用(yong)(yong)(yong)戶在市場化(hua)(hua)電(dian)(dian)價的(de)基礎上繼續執行階梯(ti)電(dian)(dian)價政策(ce)。


(四)擁(yong)有燃煤(mei)自(zi)(zi)(zi)備電(dian)(dian)廠(chang)的企(qi)業(ye)按(an)照國家有關(guan)規定承(cheng)擔(dan)政(zheng)府(fu)性基金及(ji)附(fu)加、政(zheng)策(ce)性交叉補(bu)貼、普遍(bian)服務和社會責任,按(an)約(yue)定向電(dian)(dian)網企(qi)業(ye)支付系(xi)(xi)統備用費,取得電(dian)(dian)力業(ye)務許可證,達到能效、環(huan)保要求,成為(wei)合(he)格市場主體后,有序推進(jin)其自(zi)(zi)(zi)發自(zi)(zi)(zi)用以(yi)外電(dian)(dian)量按(an)交易規則(ze)參與交易。為(wei)促進(jin)和鼓勵資源綜合(he)利用,對回收利用工業(ye)生(sheng)(sheng)產過(guo)程中產生(sheng)(sheng)可利用的熱能、壓差以(yi)及(ji)余(yu)氣(qi)等(deng)(deng)建設相應規模的余(yu)熱、余(yu)壓、余(yu)氣(qi)自(zi)(zi)(zi)備電(dian)(dian)廠(chang),繼續實施減免(mian)系(xi)(xi)統備用費和政(zheng)策(ce)性交叉補(bu)貼等(deng)(deng)相關(guan)支持政(zheng)策(ce)。


(五(wu))各地政府主(zhu)管部門要(yao)會同電網(wang)企(qi)業,細(xi)(xi)化研(yan)究并(bing)詳細(xi)(xi)梳理暫不參與(yu)市場的(de)用(yong)戶清(qing)單,掌(zhang)握經(jing)營性(xing)電力用(yong)戶參與(yu)市場化交易情(qing)況(kuang),逐步建立分行業電力用(yong)戶參與(yu)市場化交易統計(ji)分析制度,及時掌(zhang)握經(jing)營性(xing)電力用(yong)戶全面放開情(qing)況(kuang)。


二(er)、支(zhi)持中小用戶參(can)與市場化交易


(六(liu))積極支持中(zhong)小用(yong)(yong)戶(hu)由(you)售電公(gong)司代理(li)參(can)加(jia)市場化交易,中(zhong)小用(yong)(yong)戶(hu)需與售電公(gong)司簽(qian)訂代理(li)購電合同(tong),與電網(wang)企(qi)業簽(qian)訂供(gong)用(yong)(yong)電合同(tong),明確有關權責義務(wu)。


(七)經(jing)營性電力(li)用(yong)戶(hu)(hu)全面放開參(can)與(yu)市場(chang)化交易主(zhu)要形(xing)式(shi)(shi)可(ke)(ke)以(yi)包括直(zhi)接參(can)與(yu)、由(you)售電公司代理參(can)與(yu)、其(qi)他各(ge)地根據實際情況研究明確的(de)市場(chang)化方式(shi)(shi)等(deng),各(ge)地要抓(zhua)緊(jin)研究并合理制定中小用(yong)戶(hu)(hu)參(can)與(yu)市場(chang)化交易的(de)方式(shi)(shi),中小用(yong)戶(hu)(hu)可(ke)(ke)根據自身實際自主(zhu)選擇(ze),也可(ke)(ke)以(yi)放棄選擇(ze)權,保持現有的(de)購電方式(shi)(shi)。各(ge)地可(ke)(ke)結合本地區電力(li)供需(xu)形(xing)勢,針(zhen)對全面放開經(jing)營性電力(li)用(yong)戶(hu)(hu)發用(yong)電計劃設定一段時間的(de)過渡(du)期(qi)。


(八(ba))針對(dui)選擇參(can)與市(shi)場化交易但無法與發電(dian)企(qi)業(ye)達成(cheng)交易意向(xiang)的(de)中小用戶(hu),過(guo)(guo)渡期(qi)(qi)內(nei)執行原(yuan)有購電(dian)方式,過(guo)(guo)渡期(qi)(qi)后執行其他市(shi)場化購電(dian)方式。


(九)退出市(shi)(shi)場(chang)化交(jiao)易(yi)或未選擇參(can)與市(shi)(shi)場(chang)化交(jiao)易(yi)的(de)中小(xiao)用(yong)戶,在再次(ci)直接參(can)與或通過(guo)代理方式參(can)與市(shi)(shi)場(chang)化交(jiao)易(yi)前,由(you)電(dian)(dian)網企(qi)業承擔保底供電(dian)(dian)責任。


三、健全全面放開(kai)經營性發用電計(ji)劃后的價格形(xing)成機制


(十)全面放開經營性(xing)發用電計劃(hua)后的價格形成機(ji)制,按照價格主管部(bu)門的有關(guan)政策執行。


(十一)對(dui)于已按(an)(an)市場化交易(yi)規(gui)則(ze)執行的電(dian)量(liang),價格仍按(an)(an)照市場化規(gui)則(ze)形成。鼓(gu)勵電(dian)力用戶和發電(dian)企業自主協商簽訂合(he)同時,以(yi)靈活可浮動的形式確定(ding)(ding)具(ju)體價格,價格浮動方式由雙方事先約定(ding)(ding)。


四、切實做好公益性用電(dian)的供(gong)應保障工作


(十二(er))各地(di)要(yao)進一步落實規范優(you)先(xian)發電、優(you)先(xian)購(gou)電管理有關要(yao)求,對農業、居民生活及黨政機關、學(xue)校、醫院、公(gong)共(gong)交通(tong)(tong)、金融(rong)、通(tong)(tong)信、郵政、供水、供氣等重要(yao)公(gong)用事業、公(gong)益性服務等用戶(hu)安(an)排優(you)先(xian)購(gou)電。結合(he)本地(di)實際,加強分類(lei)施策,抓緊(jin)研究保障(zhang)優(you)先(xian)發電、優(you)先(xian)購(gou)電執行的措施,統籌做(zuo)好優(you)先(xian)發電優(you)先(xian)購(gou)電計劃規范管理工作。


(十三)各地(di)要根據(ju)優(you)先(xian)(xian)購電保障原則,詳細梳(shu)理優(you)先(xian)(xian)購電用(yong)戶(hu)清單,實施(shi)動態管理、跟蹤保障,原則上優(you)先(xian)(xian)購電之外的其(qi)他(ta)經營(ying)性電力用(yong)戶(hu)全部(bu)參與(yu)市(shi)場(chang)。


 (十(shi)四)各地要合理制(zhi)定有(you)序用電(dian)方案并按年(nian)度滾動調整,出現(xian)電(dian)力缺口或重大突發事件時,對優先(xian)購(gou)電(dian)用戶保障供電(dian),其他用戶按照(zhao)有(you)序用電(dian)方案承擔有(you)序用電(dian)義務(wu)。


(十(shi)五)電(dian)網企(qi)業要按照規定承(cheng)擔相關責任(ren),按照政府定價保障(zhang)(zhang)優先購電(dian)用(yong)戶(hu)用(yong)電(dian)。優先購電(dian)首先由優先發電(dian)電(dian)量予以保障(zhang)(zhang)。


五、切實(shi)做(zuo)好規劃(hua)內清潔電(dian)源(yuan)的發電(dian)保障工作


(十六)研究推(tui)進保(bao)(bao)(bao)障(zhang)(zhang)優(you)先(xian)發(fa)(fa)電(dian)(dian)(dian)政策執行,重(zhong)點考慮核電(dian)(dian)(dian)、水(shui)(shui)電(dian)(dian)(dian)、風電(dian)(dian)(dian)、太陽(yang)能發(fa)(fa)電(dian)(dian)(dian)等清潔能源(yuan)的保(bao)(bao)(bao)障(zhang)(zhang)性收(shou)(shou)購(gou)(gou)。核電(dian)(dian)(dian)機組發(fa)(fa)電(dian)(dian)(dian)量(liang)(liang)(liang)納(na)入優(you)先(xian)發(fa)(fa)電(dian)(dian)(dian)計(ji)(ji)劃(hua)(hua),按照(zhao)(zhao)優(you)先(xian)發(fa)(fa)電(dian)(dian)(dian)優(you)先(xian)購(gou)(gou)電(dian)(dian)(dian)計(ji)(ji)劃(hua)(hua)管理有關工(gong)作(zuo)要求做好(hao)(hao)保(bao)(bao)(bao)障(zhang)(zhang)消(xiao)納(na)工(gong)作(zuo)。水(shui)(shui)電(dian)(dian)(dian)在(zai)(zai)消(xiao)納(na)條(tiao)件(jian)較好(hao)(hao)地(di)區,根據(ju)來(lai)水(shui)(shui)情況,兼顧資源(yuan)條(tiao)件(jian)、歷史(shi)均值和綜合(he)利(li)用(yong)等要求,安排(pai)(pai)優(you)先(xian)發(fa)(fa)電(dian)(dian)(dian)計(ji)(ji)劃(hua)(hua);在(zai)(zai)消(xiao)納(na)受限地(di)區,以近年(nian)(nian)發(fa)(fa)電(dian)(dian)(dian)量(liang)(liang)(liang)為基礎(chu),根據(ju)市場空間安排(pai)(pai)保(bao)(bao)(bao)量(liang)(liang)(liang)保(bao)(bao)(bao)價(jia)的優(you)先(xian)發(fa)(fa)電(dian)(dian)(dian)計(ji)(ji)劃(hua)(hua),保(bao)(bao)(bao)量(liang)(liang)(liang)保(bao)(bao)(bao)價(jia)之(zhi)外的優(you)先(xian)發(fa)(fa)電(dian)(dian)(dian)量(liang)(liang)(liang)通(tong)過(guo)市場化方(fang)式(shi)確(que)定(ding)(ding)價(jia)格。風電(dian)(dian)(dian)、太陽(yang)能發(fa)(fa)電(dian)(dian)(dian)等新能源(yuan),在(zai)(zai)國家未核定(ding)(ding)最(zui)(zui)低保(bao)(bao)(bao)障(zhang)(zhang)收(shou)(shou)購(gou)(gou)年(nian)(nian)利(li)用(yong)小時數的地(di)區按照(zhao)(zhao)資源(yuan)條(tiao)件(jian)全額(e)安排(pai)(pai)優(you)先(xian)發(fa)(fa)電(dian)(dian)(dian)計(ji)(ji)劃(hua)(hua);在(zai)(zai)國家核定(ding)(ding)最(zui)(zui)低保(bao)(bao)(bao)障(zhang)(zhang)收(shou)(shou)購(gou)(gou)年(nian)(nian)利(li)用(yong)小時數的地(di)區,結合(he)當地(di)供需(xu)形(xing)勢合(he)理安排(pai)(pai)優(you)先(xian)發(fa)(fa)電(dian)(dian)(dian)計(ji)(ji)劃(hua)(hua),在(zai)(zai)國家核定(ding)(ding)最(zui)(zui)低保(bao)(bao)(bao)障(zhang)(zhang)收(shou)(shou)購(gou)(gou)年(nian)(nian)利(li)用(yong)小時數內(nei)電(dian)(dian)(dian)量(liang)(liang)(liang)保(bao)(bao)(bao)量(liang)(liang)(liang)保(bao)(bao)(bao)價(jia)收(shou)(shou)購(gou)(gou)基礎(chu)上,鼓(gu)勵超過(guo)最(zui)(zui)低保(bao)(bao)(bao)障(zhang)(zhang)收(shou)(shou)購(gou)(gou)年(nian)(nian)利(li)用(yong)小時數的電(dian)(dian)(dian)量(liang)(liang)(liang)通(tong)過(guo)參與市場化交易方(fang)式(shi)競爭上網(wang)。


(十七)積極推進風(feng)電(dian)(dian)、光(guang)(guang)(guang)伏發(fa)電(dian)(dian)無補貼(tie)平(ping)價(jia)上(shang)(shang)網(wang)工(gong)作,對平(ping)價(jia)上(shang)(shang)網(wang)項(xiang)目和(he)低價(jia)上(shang)(shang)網(wang)項(xiang)目,要將全部(bu)電(dian)(dian)量(liang)納入優(you)先發(fa)電(dian)(dian)計劃予以保障,在同(tong)等條件下優(you)先上(shang)(shang)網(wang)。平(ping)價(jia)上(shang)(shang)網(wang)項(xiang)目和(he)低價(jia)上(shang)(shang)網(wang)項(xiang)目如存在棄(qi)(qi)(qi)風(feng)、棄(qi)(qi)(qi)光(guang)(guang)(guang)情況,由省級政(zheng)府(fu)主管部(bu)門會同(tong)電(dian)(dian)網(wang)企業(ye)將棄(qi)(qi)(qi)風(feng)、棄(qi)(qi)(qi)光(guang)(guang)(guang)電(dian)(dian)量(liang)全額核定為(wei)可(ke)轉讓的(de)優(you)先發(fa)電(dian)(dian)計劃,可(ke)在全國范圍(wei)內通過(guo)發(fa)電(dian)(dian)權交(jiao)易(yi)轉讓給其他發(fa)電(dian)(dian)企業(ye)并獲取收(shou)益。電(dian)(dian)力交(jiao)易(yi)機(ji)構要按要求做好棄(qi)(qi)(qi)風(feng)、棄(qi)(qi)(qi)光(guang)(guang)(guang)優(you)先發(fa)電(dian)(dian)計劃的(de)發(fa)電(dian)(dian)權交(jiao)易(yi)的(de)組織工(gong)作,推動(dong)交(jiao)易(yi)落實。


(十八(ba))電網企業、電力用戶和售電公(gong)司應(ying)按要求承(cheng)擔相關責任,落實(shi)清潔能源消納義(yi)務。鼓勵參與跨省跨區市(shi)(shi)場化交易的市(shi)(shi)場主體消納優先發電計劃外增送清潔能源電量。


(十九)鼓勵經營性(xing)電(dian)(dian)(dian)力(li)用戶與核電(dian)(dian)(dian)、水(shui)電(dian)(dian)(dian)、風(feng)電(dian)(dian)(dian)、太陽能(neng)發電(dian)(dian)(dian)等(deng)清(qing)潔(jie)能(neng)源(yuan)開展(zhan)市場化交(jiao)(jiao)易,消(xiao)納計劃外增送清(qing)潔(jie)能(neng)源(yuan)電(dian)(dian)(dian)量。電(dian)(dian)(dian)力(li)交(jiao)(jiao)易機構要(yao)積極(ji)做好清(qing)潔(jie)能(neng)源(yuan)消(xiao)納交(jiao)(jiao)易組織(zhi)工作,進(jin)一步降低棄(qi)水(shui)、棄(qi)風(feng)、棄(qi)光現象。


(二十)清潔能源消納受限地區要(yao)加快落實將優先發電(dian)計(ji)劃分為(wei)“保(bao)量(liang)保(bao)價(jia)(jia)(jia)(jia)(jia)”和“保(bao)量(liang)競價(jia)(jia)(jia)(jia)(jia)”兩部(bu)分,其中“保(bao)量(liang)競價(jia)(jia)(jia)(jia)(jia)”部(bu)分通過(guo)市場(chang)化方式形成價(jia)(jia)(jia)(jia)(jia)格,市場(chang)化交易未成交部(bu)分可(ke)執(zhi)行本地區同(tong)類型機(ji)組市場(chang)化形成的平(ping)均(jun)購電(dian)價(jia)(jia)(jia)(jia)(jia)格。


六(liu)、加強電力直(zhi)接交(jiao)易的履約(yue)監管(guan)


(二十一)各地要有針對性地制(zhi)定和完善相關規章(zhang)制(zhi)度,實施(shi)守(shou)信(xin)聯合激勵(li)和失信(xin)聯合懲戒機(ji)制(zhi),加強電力(li)直接(jie)(jie)交(jiao)易的履約(yue)監管力(li)度。市場主體按照市場交(jiao)易規則(ze)組織簽訂直接(jie)(jie)交(jiao)易合同(tong),明(ming)確相應的權利義務(wu)關系(xi)、交(jiao)易電量和價格(ge)等重要事(shi)項,并嚴格(ge)按照合同(tong)內容履約(yue)執行。


(二十二)地(di)方經濟(ji)運行部門(men)要會同(tong)電(dian)網企(qi)業(ye)、電(dian)力(li)交易(yi)(yi)機(ji)構對電(dian)力(li)直接(jie)(jie)交易(yi)(yi)合同(tong)履約情況(kuang)實行分月統計,發揮電(dian)網企(qi)業(ye)及電(dian)力(li)交易(yi)(yi)機(ji)構作(zuo)用,將直接(jie)(jie)交易(yi)(yi)合同(tong)履約情況(kuang)納入統一管(guan)理,在(zai)一定(ding)范圍內(nei)按季(ji)度通報。國家(jia)能源局派出(chu)機(ji)構對轄區內(nei)電(dian)力(li)直接(jie)(jie)交易(yi)(yi)合同(tong)履約情況(kuang)進行監管(guan)。


(二(er)十三(san))發電(dian)企業、電(dian)力用(yong)(yong)戶、售電(dian)公司(si)等市場(chang)主體要牢固樹立市場(chang)意識(shi)、法律意識(shi)、契約意識(shi)和(he)信用(yong)(yong)意識(shi),直接交(jiao)易合同(tong)達成后必須(xu)嚴(yan)格執(zhi)行,未按(an)合同(tong)條(tiao)款(kuan)執(zhi)行需承擔相(xiang)應(ying)違約責任并(bing)接受(shou)相(xiang)關考核懲(cheng)罰。


七、保障措施


(二十四)各地要根據實際情況,采取積(ji)極措施確保跨(kua)省跨(kua)區(qu)(qu)(qu)交(jiao)易(yi)與各區(qu)(qu)(qu)域、省(區(qu)(qu)(qu)、市(shi)(shi))電力市(shi)(shi)場(chang)(chang)協調運作。在跨(kua)省跨(kua)區(qu)(qu)(qu)市(shi)(shi)場(chang)(chang)化交(jiao)易(yi)中,鼓(gu)勵網(wang)對網(wang)、網(wang)對點(dian)的直(zhi)接交(jiao)易(yi),對有(you)條(tiao)件的地區(qu)(qu)(qu),有(you)序(xu)支持點(dian)對網(wang)、點(dian)對點(dian)直(zhi)接交(jiao)易(yi)。各地要對跨(kua)省跨(kua)區(qu)(qu)(qu)送受端(duan)市(shi)(shi)場(chang)(chang)主體對等放開,促進資源(yuan)大范圍優化配(pei)置和(he)清潔能(neng)源(yuan)消納。北京、廣州電力交(jiao)易(yi)中心和(he)各地電力交(jiao)易(yi)機(ji)構要積(ji)極創造條(tiao)件,完善交(jiao)易(yi)規(gui)則、加強機(ji)制(zhi)建設、搭建交(jiao)易(yi)平臺,組織(zhi)開展跨(kua)省跨(kua)區(qu)(qu)(qu)市(shi)(shi)場(chang)(chang)化交(jiao)易(yi)。


(二(er)十五)中國(guo)電力(li)(li)(li)企(qi)業聯(lian)合會、第三方(fang)信用(yong)(yong)服務(wu)機(ji)構和各電力(li)(li)(li)交(jiao)易(yi)機(ji)構開展(zhan)電力(li)(li)(li)交(jiao)易(yi)信用(yong)(yong)數據采集,建(jian)立動態信用(yong)(yong)記(ji)錄數據庫,適時公布有關履(lv)約(yue)信用(yong)(yong)狀況。對誠實守信、認真履(lv)約(yue)的企(qi)業納入誠信記(ji)錄,對履(lv)約(yue)不力(li)(li)(li)甚至惡意違約(yue)的企(qi)業納入不良信用(yong)(yong)記(ji)錄并(bing)視情況公開通報,對存在違法(fa)、違規行為(wei)和列入“黑(hei)名單”的嚴重失信企(qi)業執行聯(lian)合懲戒措施。


(二十六(liu))各(ge)(ge)省(區(qu)、市(shi))政(zheng)府(fu)主管部門(men)每月向(xiang)國(guo)家(jia)發(fa)展改革委(wei)報送全面(mian)放(fang)開(kai)發(fa)用(yong)電(dian)(dian)計(ji)(ji)劃進展情況。各(ge)(ge)電(dian)(dian)力交(jiao)易(yi)機(ji)構(gou)、電(dian)(dian)網(wang)企業負責市(shi)場(chang)化交(jiao)易(yi)的組織和(he)落實,配合有關部門(men)開(kai)展監管。各(ge)(ge)電(dian)(dian)力交(jiao)易(yi)機(ji)構(gou)開(kai)展對市(shi)場(chang)交(jiao)易(yi)的核(he)查,按時向(xiang)各(ge)(ge)地政(zheng)府(fu)主管部門(men)報告有關情況。國(guo)家(jia)能源局(ju)派(pai)出機(ji)構(gou)對轄區(qu)內各(ge)(ge)省(區(qu)、市(shi))全面(mian)放(fang)開(kai)發(fa)用(yong)電(dian)(dian)計(ji)(ji)劃執行情況進行監督,每季(ji)度向(xiang)國(guo)家(jia)發(fa)展改革委(wei)、國(guo)家(jia)能源局(ju)報送相關情況。
